All Aboard Travel and Cruise – Terms and Conditions

1. Introduction

These Terms and Conditions (“Terms”) govern the use of All Aboard Travel and Cruise (“All Aboard”, “we”, “us”, or “our”) services, including but not limited to trip booking, travel consultation, and itinerary planning. By using All Aboard’s services, you (“you” or “client”) agree to be bound by these Terms.

2. Role of All Aboard Travel and Cruise

All Aboard acts as an independent contractor and works in partnership with WorldVia Travel Quest Network (the “Host Agency”). We act as your agent in securing travel arrangements, including flights, cruises, accommodations, tours, and other travel-related services, from various travel suppliers (“Suppliers”). All Aboard does not operate or control these Suppliers and is not responsible for their acts or omissions.

3. Booking and Payment

  • Booking: To initiate a booking, you will provide details about your desired trip. All Aboard will research options, present recommendations, and obtain your final approval before booking with Suppliers.
  • Payment: You are responsible for all trip costs, including but not limited to travel fares, accommodation rates, activity fees, taxes, and any service fees charged by All Aboard. Payment terms, including deposit amounts and final payment deadlines, will be communicated during the booking process. We will collect your payment and forward it to the respective Suppliers according to their terms.

4. Changes and Cancellations

  • Changes: Changes to your booking after confirmation may be subject to fees imposed by Suppliers. All Aboard will inform you of any applicable change fees before processing your request.
  • Cancellations: Cancellation fees vary depending on the Supplier’s policy. All Aboard will provide cancellation details before booking and advise you of any cancellation fees you may incur. We are not responsible for non-refundable deposits or penalties imposed by Suppliers.

5. Travel Protection

We strongly recommend purchasing travel protection insurance to safeguard your investment. Travel protection can cover trip cancellation, interruption, medical expenses, and other unforeseen circumstances. All Aboard can assist you in choosing a travel protection plan that meets your needs, but the purchase of this insurance is optional.

6. Client Responsibilities

  • Travel Documents: You are responsible for obtaining and ensuring the validity of all necessary travel documents, including passports, visas, and vaccinations, as required for your chosen destinations. Up-to-date travel advisories and entry requirements can be found on the U.S. Department of State website (https://travel.state.gov/)
  • Health: It is your responsibility to ensure you are in good health and meet any physical requirements for your chosen travel activities.

7. Disclaimer of Liability

All Aboard acts in good faith to provide accurate information and arrange travel services on your behalf. However, we cannot be held liable for:

  • Acts, omissions, or negligence of Suppliers
  • Any personal injury, illness, loss, or damage you may suffer during your trip
  • Delays, cancellations, or disruptions caused by factors beyond our control (e.g., weather, strikes, political unrest)
  • Inaccuracy of information provided by Suppliers

8. Limitation of Liability

All Aboard’s total liability for any claim arising from these Terms is limited to the service fees charged for your specific trip booking. We are not liable for any consequential, indirect, or punitive damages.

9. Force Majeure

All Aboard is not responsible for any cancellation, delay, or disruption caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, pandemics, or government restrictions.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas.

11. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Terrell, Texas.

12. Entire Agreement

These Terms constitute the entire agreement between you and All Aboard regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
